Resignation Letter of Election Officer

Dear contestent, Members of IAP, Care taker CEC, Members of Election Tribunal, Convenors of Branches \State Branches.

I, Dr. A.K.BHANAGAR, Election Officer, along with members wish to inform you:

Legal opinion tendered by an Advocate here in Delhi, goes against the directions of the Election Tribunal orders dated 13th April 2006 and 24th May 2006.,

Election Tribunal, in both of their orders directed for re-election for the existing contestants only and by including the name of Dr. A.K.SAXENA, for the posts of Vice- President and CEC, member with fresh Ballot paper, bio-data, manifesto.

Name of Dr. A.K.SAXENA, was rejected by the Election Committee, on the ground that his proposer name does not appear in the electoral roll provided by the General Secretary of IAP.But Election Tribunal insist to include the name of Dr. Saxena in the list of contestants in the re-election since his proposer Dr. R.C. SHARMA HAS PRODUCED A LIFE CERTIFICATE, with registration no. 3475.
(Even their own finding says that Dr. Sharma is registered as Associate member3468) Incidentally 3475number is also allotted to Dr. C.SANKER KUMAR, WHO HIMSELF HAS PROPOSED ANOTHER CANDIDATE IN THIS ELECTION.
Second reason given by the Tribunal is on the editing of bio-data, manifesto and design of ballot papers.
In designing of the ballot paper our main concern was to stick to the election protocol as given in the constitution;
          a) Ballot Paper should have the seal of IAP
          b) Should have signature.
          c) Should have numbering on the ballot paper,
          d) To ensure that duplicate can not be made easily, beside clear and readable.
Election Tribunal did not rely on this aspect but relied on the complaints of contestants that;
          a) Names are too small.
          b) Corresponding square is too far from the names of contestants.
          c) That there is no numbering in the corresponding square, so that it becomes difficult to cast the votes.etc.

Regarding editing of bio-data and manifesto is concerned majority of bio- data, manifesto submitted by the contestants were exceeding the prescribed words limits, therefore to edit the bio-data manifesto become essential. When I informed about this to contestants no one objected, and when we did it, President, Vice-President, Gen.Secretary were amongst the complainants. Tribunal relied on the complainants only like they did for designing of ballot paper.

As regard to omission of one name of the contestant from the post of Executive member and wrong name(s) of contestant in the ballot paper along with wrong printing of degree\diploma of one contestant which the tribunal has referred to, I as the Election Officer submitted that I owe the full responsibility and the election could be held for the CEC posts only. This was before the first order of the Tribunal which was delivered on 13.4.2006.In between the two orders of Tribunal both the contestants withdrew their complaints.
But Election Tribunal stick to their decision and directed to hold re election for all the posts with certain direction to be followed in the re-election .This order of dated24.5.2006 did not lift the embargo on the counting of votes.

Dear colleagues, my conscious does not allow me for re-election, and therefore I am not being able to follow the direction of the Tribunal. Therefore submit my resignation from the post of ELECTION OFFICER. Let members of IAP WHO FORM GENERAL BODY TO DECIDE THE FUTURE ACTION.
