Dr. Jha- can Dr. Senthil say something on this topic? I got few calls from Chennai also regarding
this. Someone was saying that physiotherapy is not mentioned there. Sowhat is the exact scenario?
Dr. Senthil Kumar (9061) TN IAP president- regarding the query, TN state branch along with
central IAP has given the memorandum to the govt. regarding 11 points of independent practice are
given to health minister and health secretary. Both are arranging the meeting with physiotherapists
and higher officials. But till date govt has not responded. I have got one thing before the Pongal
again the TN IAP has given letter to govt, to form the standing guidelines for the registration of
physiotherapist.Another thing I had on PT for clinical establishment act committee members, so on
this as well govt is not responding.
Dr. Jha- canDr. Desikamani say something?
Dr. Desikamani- for information of the members, the clinical establishment. Act was constituted,
and there was a notification given from the govt fro registration, they had said they will be releasing
the online portal.After theportal released we found there was no provisionmade for physiotherapist
for central registration. Earlier to it he had already met the minister and health secretary, due to legal
and logical issues they said they'll get back to us, for interaction soon and find a solution for it. So
TN branch has made a proper representation. I am very sure that govt will take initiative to call and
address this matter.
Dr. Jha- just to add on we have a supreme court lawyer in Delhi, he is also dealing with the same act,
I will give you his number you can contact himdirectly.
Dr Centhil- Explanation to the process, on behalf of TN state branch, we have gone to gov sector, so
many other small associations were also there. But the govt wants the authorised association to
come forward. So theywill call us for interactions they have said.
Dr. Jha- that's what I am suggesting better go into the core of it. I will give supreme court lawyer's
number to Dr. Senthil and Dr. Desikamani, they have one local lawyer also in Chennai let the be
together and take a decision.
Dr. Prabhat Ranjan- Regarding Clinical Estb.Act, nowhere it is written that we can practice without
prescription, those is minutes of the meeting. And when you will go and read theAct of 2010, there
Physiotherapy is not mentioned. And it says that whatever National Council says or whatever rule
they will be framing, that should be notified and yet those minutes of the meeting has not been
notified so it is not in practice, it can be challenged and it should not be implemented or forced to be
worked on that basis. Now a days we are saying that they are quoting the minutes of the meeting
which was held in the ministry 2 years back. But that is not yet valid. So we can challenge on that
point.And whatever your DMS is saying is not correct because it will be total violation of article 19
,1-G of Indian Constitution, which says that any person can practice his profession trade or
occupation,
Dr. Centhil- Still some states are already having clinical estb. Act. Where PT are registering their
clinics. How come it is possible.
